1. GENERAL_TERMS

At QuantumScalStudio, Psje. San Pedro 3, Vitoria-Gasteiz, Araba/Alava, Espana, we are committed to delivering high-quality digital services. This Refund Policy outlines the conditions under which refunds may be issued for services rendered.

2. PROJECT_CANCELLATION

If you wish to cancel a project after work has commenced:

• Within 48 hours of project initiation: Full refund minus administrative fees (10%)
• After 48 hours but before 25% completion: 50% refund of the total project fee
• After 25% completion: No refund. All work completed up to that point remains billable
• After 50% completion: Full project fee is non-refundable

3. MILESTONE_PAYMENTS

For projects structured around milestone payments:

• Completed milestones are non-refundable once deliverables have been approved
• Upcoming milestones can be cancelled with 7 days written notice before the milestone start date
• Refunds for cancelled milestones are processed within 14 business days

4. DEFECTIVE_DELIVERABLES

If delivered work materially fails to meet the agreed specifications outlined in the project scope document:

• We will first attempt to remedy the deficiency at no additional cost within 30 days
• If remediation is not possible, a partial or full refund will be issued based on the nature of the deficiency
• Claims must be submitted within 14 days of delivery with documented evidence of specification deviation

5. NON_REFUNDABLE_ITEMS

The following are not eligible for refunds:

• Third-party software licenses or subscriptions purchased on your behalf
• Domain registration or hosting fees already provisioned
• Work completed based on your approved designs or specifications that later change
• Services rendered under the ENTERPRISE_FUSION module after the first 14-day cooling-off period

6. REFUND_PROCESS

To request a refund, contact [email protected] with your project reference number and detailed justification. All refund requests are reviewed within 5 business days. Approved refunds are processed via the original payment method within 14 business days.

1. AGREEMENT

By engaging the services of QuantumScalStudio, located at Psje. San Pedro 3, Vitoria-Gasteiz, Araba/Alava, Espana, you agree to be bound by these Terms of Service. These terms constitute a legally binding agreement between you (the Client) and QuantumScalStudio (the Service Provider).

2. SCOPE_OF_SERVICES

Services are defined in the project proposal or statement of work (SOW) agreed upon by both parties. Any modifications to the scope must be documented in writing and signed by both parties. Additional work outside the agreed scope will be quoted separately and requires Client approval before commencement.

3. PAYMENT_TERMS

Payment terms are specified in each project proposal. Standard terms include:

• 50% deposit required before project commencement
• Remaining balance due upon project completion and delivery
• Milestone-based payments as specified in the SOW for larger projects
• All invoices are payable within 14 days of issue date
• Late payments incur a 2% monthly interest charge in compliance with EU Directive 2011/7/EU

4. INTELLECTUAL_PROPERTY

Upon full payment, all intellectual property rights for custom-developed work transfer to the Client. This includes source code, design files, and content created specifically for the project. QuantumScalStudio retains the right to use general methodologies, frameworks, and non-proprietary code libraries developed during the project.

5. CONFIDENTIALITY

Both parties agree to maintain the confidentiality of proprietary information shared during the project engagement. This obligation survives the termination of the agreement for a period of 3 years. Confidential information includes but is not limited to business strategies, technical specifications, and financial data.

6. LIABILITY_LIMITATIONS

QuantumScalStudio's total liability under any agreement shall not exceed the total fees paid by the Client for the specific project giving rise to the claim. We shall not be liable for indirect, incidental, special, or consequential damages, including loss of profits, data, or business opportunities.

7. TERMINATION

Either party may terminate the agreement with 30 days written notice. QuantumScalStudio may terminate immediately if the Client breaches material terms, including payment obligations. Upon termination, the Client is responsible for payment of all work completed up to the termination date.

8. GOVERNING_LAW

These terms are governed by the laws of Spain and the European Union. Any disputes shall be resolved in the courts of Vitoria-Gasteiz, Araba/Alava, Espana, in accordance with EU consumer protection regulations.

9. AMENDMENTS

QuantumScalStudio reserves the right to modify these Terms of Service at any time. Material changes will be communicated to active Clients via email at least 30 days before taking effect. Continued use of our services after changes take effect constitutes acceptance of the modified terms.
